By accessing the Site, browsing the Site, placing an order, creating an account, contacting us, or using any part of our services, you agree to be bound by these Terms & Conditions (“Terms”), including our Privacy Policy, Shipping Policy, and Returns, Replacements & Refunds Policy, which are incorporated by reference.

Please read these Terms carefully. If you do not agree with these Terms, you must not use the Site or purchase from us.

1. Legal and E-Commerce Disclosures

These Terms are prepared with reference to applicable Indian laws, including the Indian Contract Act, 1872, Consumer Protection Act, 2019, Consumer Protection (E-Commerce) Rules, 2020, Information Technology Act, 2000, and applicable data protection laws, to the extent applicable.

  • Products are subject to availability and may be discontinued at any time.

7. Orders, Billing, and Customer Information

You agree to provide accurate, complete, and current information for all orders, including name, phone number, email address, billing details, shipping details, and payment information. We are not responsible for delivery failure or delay due to incorrect, incomplete, or unreachable customer details.

We may refuse, cancel, or limit any order where we suspect fraud, misuse of offers, abnormal purchase patterns, resale activity, COD misuse, incorrect information, technical error, payment failure, or violation of these Terms.

8. Payments

Online payments are processed by secure third-party payment gateway partners. We do not store your full card details, CVV, or net banking password on our own servers. Payment confirmation, failure, refund, and settlement timelines may depend on payment gateway and banking partners.

9. Cash on Delivery (COD) and Refusal Abuse

COD may be available only for eligible orders and serviceable locations. Any COD handling charges will be displayed at checkout.

Repeated refusal of COD orders, repeated customer unavailability, suspicious COD activity, or misuse of COD privileges may result in cancellation of orders, suspension of COD availability, or restriction of future orders, subject to applicable law.

10. Subscription, Prepaid Plan, and Monthly Delivery Terms

Bubble Me may offer subscription boxes, prepaid plans, prepaid bundles, monthly delivery plans, or Build Your Own subscription boxes from time to time. These plan terms apply in addition to the product page, checkout page, Shipping Policy, and Returns, Replacements & Refunds Policy.

  • Unless expressly stated otherwise at checkout, prepaid subscription plans are billed upfront for the selected duration and are not automatically renewed.
  • Plan names, duration, quantity rules, product selection rules, price, discounts, and shipment schedule will be shown on the relevant product or subscription page. For Build Your Own boxes, the customer must follow the displayed selection quantity rules before checkout.
  • Scheduled shipments may be dispatched monthly or as otherwise described on the plan page. Actual dispatch and delivery dates may vary based on processing time, product availability, weekends, public holidays, and courier serviceability.
  • Address changes, product selection changes, plan changes, or cancellation requests for future shipments must be raised before the relevant shipment is packed, billed, or dispatched. Once a shipment is dispatched, it is governed by our Shipping Policy and Returns, Replacements & Refunds Policy.
  • Mid-plan cancellation for change of mind or personal preference is not guaranteed. Where a cancellation or refund for unfulfilled future shipments is approved, it may be calculated proportionately after adjusting delivered/shipped products, discounts, promotional benefits, shipping charges, payment gateway charges where applicable, and deductions permitted by law.
  • If a scheduled shipment cannot be fulfilled due to stock unavailability, product discontinuation, courier non-serviceability, or operational reasons, we may offer an alternate product, reschedule the shipment, or provide a proportionate refund for the unfulfilled shipment value.
  • If we introduce any recurring auto-renewal or auto-debit plan in the future, the renewal frequency, billing amount, payment method, cancellation process, and consent mechanism will be displayed before purchase or renewal.

11. Shipping, Delivery, Cancellation, Replacement, and Refunds

Shipping, delivery timelines, delayed delivery, failed delivery, cancellation before dispatch, replacement eligibility, unboxing video requirements, and refund timelines are governed by our Shipping Policy and Returns, Replacements & Refunds Policy.

As required under applicable consumer protection and e-commerce rules, we aim to process eligible refund requests within a reasonable period and as prescribed by applicable law, payment gateway rules, and bank timelines.

12. Marketplace and Third-Party Platform Orders

These Terms apply to purchases made on www.bubbleme.in. If you buy Bubble Me products through Amazon, Blinkit, Nykaa, Flipkart, Purplle, or any other marketplace or third-party platform, that platform’s terms, shipping, return, cancellation, and refund policies may also apply.

13. Account, Password, and Security

If you create an account or access order information through login tools, you are responsible for maintaining confidentiality of your login credentials, OTPs, device access, and account activity. Please notify us immediately if you suspect unauthorised use of your account.

14. Privacy and Personal Information

Your submission of personal information through the Site is governed by our Privacy Policy. By using the Site, you acknowledge that your information may be collected, used, shared, retained, and processed as described in that policy.

15. Third-Party Tools, Links, and Services

To the fullest extent permitted by law, Bubble Me, Derma Lush Private Limited, and our directors, officers, employees, affiliates, agents, suppliers, service providers, contractors, or licensors shall not be liable for indirect, incidental, punitive, special, or consequential damages, including loss of profits, revenue, data, goodwill, or replacement costs arising from your use of the Site, products, or services.

Our total aggregate liability for any claim relating to a specific order shall not exceed the amount actually paid by you for that order.

Nothing in these Terms limits or excludes any consumer rights, statutory warranties, or protections that cannot be lawfully excluded under applicable law.

You agree to indemnify and hold harmless Bubble Me, Derma Lush Private Limited, and our affiliates, directors, officers, employees, agents, suppliers, service providers, and partners from any claim, loss, liability, damage, cost, or expense arising from your breach of these Terms, misuse of the Site, violation of law, fraudulent activity, or infringement of third-party rights.
